General Terms and Conditions (GTC)

1. Acceptance of Terms
By creating an account, accessing, or using Benefactory (also operating as FeaturesToBenefits.ai) (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
2. Description of Service
Benefactory is an AI-powered SaaS application that converts product feature lists/specifications into marketing benefits and copy. We provide various tools for generating, editing, and managing marketing content using artificial intelligence.
3. User Accounts
3.1 Registration
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
3.2 Security
You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscriptions and Billing
4.1 Paid Plans
Certain features of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually).
4.2 Payments
We use Stripe as our payment processor. By subscribing, you agree to pay all fees in accordance with the pricing terms presented at the time of purchase.
4.3 Cancellation
You may cancel your Subscription at any time through your account settings. Your cancellation will take effect at the end of the current paid term. There are no refunds for partial months or unused credits, except where required by law.
5. Intellectual Property Rights
5.1 Your Content
You retain all rights, title, and interest in the input data you provide ("Input") and the content generated by the Service ("Output"). We do not claim ownership over your copy.
5.2 License to Use
By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to process, host, and store your Input and Output solely for the purpose of providing the Service to you.
5.3 Our IP
The Service itself, including its code, design, interface, and proprietary algorithms (excluding your specific content), is the property of Benefactory and is protected by copyright and intellectual property laws.
6. Acceptable Use
You agree NOT to use the Service:
- To generate content that is illegal, harmful, threatening, abusive, defamatory, or fraudulent.
- To reverse engineer, decompile, or attempt to extract the source code of the Service.
- To use the Service to build a competitive product.
- To automate access to the Service (scraping/crawling) without our permission.
7. AI Disclaimers & Limitation of Liability
7.1 Accuracy
The Service uses Artificial Intelligence (OpenAI). AI models can occasionally produce incorrect, misleading, or offensive information ("hallucinations"). You acknowledge that you should review and verify all Output before publishing or using it commercially.
7.2 No Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
7.3 Limitation of Liability
In no event shall Benefactory be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total usage liability shall not exceed the amount you paid us in the last 12 months.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Benefactory is established, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
